
Earned Rehabilitation Incentives Proposal
1. Expand the current Earned Eligibility Program in New York, to accelerate rehabilitation.
- Provide powerful rehabilitation incentives, with safeguards, incorporating the experience from the 3-stage NYS CASAT program, the State of Delaware’s Drug Treatment Continuum, and the Federal Intensive Confinement Centers.
2. Offer sentencing incentives
with assurances, to those meeting strict criteria, for
earlier consideration by the Parole Board (or equivalent)of:
- Graduation from incarceration to Intermediate Sanctions, in the latter part of their minimum, (similar to CASAT, Delaware Continuum, & Federal ICCs) and
- Subsequent earlier release to Parole
3. Include primary incentive for achievement of all prerequisites, such as:
- intensive alcohol/drug treatment, and
- intensive education-tracks, and
- fulfillment of other rehabilitation criteria

Illustrative Earned Rehabilitation Incentive Program
Three tiers to graduation to Intermediate Sanctions and Normal Parole Supervision:
First Tier Special Review Committee
- After serving 2/3 of the minimum, inmate seeks from a Special Review Committee an Earned Rehabilitation & Good Time Allowance, off the minimum, allowing earlier appearance before the Parole Board (or equivalent). The Special Review Committee adheres to DOCS Guidelines for its review.
- This Time-Allowance is based on already completed or now-proposed programs, such as intensive alcohol/substance abuse treatment for addicts and intensive education/training-tracks, and other rehabilitation criteria. If a Time-Allowance is granted by the Special Review Committee, it becomes active only at the satisfactory completion of all prison-based program requirements.
Second Tier Parole Board (or equivalent)Review
- At the time of the minimum minus the Time-Allowance, inmate then may seek Parole Board approval of a Tier 3 (Intermediate Sanctions) further rehabilitation plan, and approval to proceed to Tier 3.
- Parole Board takes all factors into consideration, determining if and when inmate may proceed to Tier 3.
Third Tier Intermediate Sanctions
- If and when approved by Parole Board, inmate is committed to Intermediate Sanctions, and its programs, as specified by the Parole Board, with subsequent release to Normal Parole Supervison.
